Hiring Terms and Conditions

  1. DEFINITIONS

(a) The “Owner” is Quang Lap – Event Equipment Hire
(b) The “Hirer” refers to the person, firm or corporation hiring equipment from the Owner
(c) The “Equipment” means all the equipment and accessories supplied to the Hirer

(d) The “Hire period” is the standard leasing time Hirer is entitled to use the Equipment within 24 hours, since the Hirer receiving Equipment.

(e) “Terms” means these Terms and Conditions of Hire

  1. CONDITIONS OF HIRE

The hiring of the Equipment will commence from the commencement date specified and continue for the term specified.

The Owner offers 24 hours service, 7 days a week to serve any Hirer needs and requirements at the earliest convenient.

Any person signing the documents for and on behalf of the Hirer hereby covenants with the Owner that he or she has the authority of the Hirer to make this agreement on the Hirer’s behalf. Any extension and changes of service contract and payment must be agreed to by both parties.

  1. HIRING FEE & OTHER FEES

Hiring fee is the basic leasing cost that varies depending on quantities of the order, hiring period and other extra fees incurred related to the agreement by both sides in hiring time.

Transportation fee is an additional cost that varies depending on each individual order. The fee is determined by the items and quantities of the order, the delivery location, access and the dates and times of the event.

Labour fee is another additional cost that varies depending on the Hirer needs. The labour fee is defined by the order on special holidays, night working shift, or Equipment delivery and packing, loading/unloading etc… to further required location.

Cleaning fee: As an added value offering to the Hirer, the Owner accept the goods returned in unclean condition with cleaning fee free of charge.

  1. PAYMENT

– The Hirer agrees to pay the hire fee; including VAT tax, freight, damage waiver fee and other charges relevant to this agreement for the hire period.

– Payment is made by two installments as following:

1st instalment: deposit 50% of the agreed hire price upon confirmation of order;

2nd instalment: the balance of the agreed hire price and other incurred extra fees (if have) must be made within 5 days, since the Hirer return Equipment.

–  Equipment not returned on time (standared time is 24 hrs) and in accordance with this agreement will be subject to a continuance of the agreed additional costs for each hour exceeding time but less than 24 hours late enquivalent 1 day hiring fee.

–  If payment is not made on the due date, you shall be liable for interest on any amount outstanding at a rate of 0.05% per day.

  1. CANCELLATION

The Hirer may cancel an order but may forfeit any hire fees paid as follows:

(a) If booking is cancelled 1 week before the function date, will make a full refund of the paid deposit;

(b) Bookings cancelled 3 days before the function date will forfeit 20% of the total hire fee.

(c) Bookings cancelled within 24 hours of the function date will forfeit the total paid deposit.

These cancellation terms apply to cancellation of all confirmed items.

  1. DELIVERY AND COLLECTION

The goods shall be delivered in a basically clean so the Hirer should clean them with expected hygiene standard before use.

The Hirer allows any representative access to the site at all reasonable times to load and unload goods as well as provide safe and proper access to and at the site. Mutual representatives double check the quantitities and quality of the order with confirmation document that determines the payment (without changes)

The Hirer be able to pick up order directly at our warehouse. All clients pick up orders require 50% deposit confirmation invoice, company’s introducton letter or driving license for verification, vehicles, and loading/unloading labor.

  1. DAMAGE

The Hirer is responsible for the Equipment from the time of delivery until collection by the Owner and shall pay for all Equipment damage, broken or loss however caused during that period, but excluding the Damage Waiver (The damage waiver is an industry standard of the items hired value, which is included in all orders. This damage waiver covers all costs associated with normal wear and tear to the equipment )

The Hirer shall protect the Equipment from the elements during the time of delivery, use, storage and waiting period before collection.

The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the Equipment hereby hired.

  1. FORCE MAJEURE

For the purpose of this clause, “Force Majeure” means an event or circumstance beyond the reasonable control of a party, including, but not limited to, acts of God, war, rain, hail, wind, explosion, civil disobedience, legislation not in force at the date of this Agreement or labor disputes.

Neither Owner nor the Hirer will breach this agreement and each party will not be liable to the other party for delay or failure to perform its obligation under this agreement due to Force Majeure.

Quang Lap shall not be liable for any indirect or consequential losses or expenses suffered by the Hirer, including but not limited to, loss of turnover, profits, business or goodwill or any liability to any other party or for any loss or damage suffered by the Hirer as a result of any delays caused by such Force Majeure events.

  1. MISCELLANEOUS

The Hirer agrees to ensure that any site specified on the hire agreement, will be clear of all obstructions to allow Quang Lap to erect, install or place the hire equipment safely.

These terms and conditions are governed by the Laws of Vietnam Government and the Hirer and the Owner submit to the jurisdiction of the courts of Government.
